ARTICLE 1. DEFINITIONS
“General Terms of Use”: refers to this document, formalizing the contractual relationship between the User and the Fondation, in the context of the use of the Site.
“The Fondation”: refers to the publisher of this Site and the host of content published on the Site by users.

ARTICLE 2. PURPOSE
These Terms of Use are intended to define the conditions for access and use of the Site accessible at the following URL: https://www.laciteduvin.com.
Any access and/or use of this Website implies express and unconditional acceptance of and compliance with the entirety of these General Terms of Use. They therefore constitute a contract between the Fondation and the User.
ARTICLE 3. ACCESS TO THE SITE
Users of this Site acknowledge that they have the skills and resources necessary to access and use this Site. They also acknowledge that they have verified that the computer configuration they are using contains no viruses and is in proper working condition.
The Fondation shall seek to implement all necessary means to keep the Site accessible for Users, except in cases of force majeure or events beyond its control, and subject to any possible outages, or maintenance activities necessary for the proper operation of the Site.
All costs relating to access to the Site, whether for hardware, software or internet access, shall be borne exclusively by the User. Users alone shall be responsible for the proper functioning of their computer equipment and their access to the Internet.
It is specified that the Fondation may not be held liable for any disruption of Internet service or inability of the User to utilize the Site, whatever the cause, especially during periods when information is being updated and/or improvements are being made to the programs and/or hardware necessary for the proper functioning of the Site.
In addition, the Fondation may need to suspend its provision of the Site at any time, without prior notice and without compensation. The User acknowledges and accepts that the Fondation is not responsible for any interruption in service or any consequences this may have for the User.
ARTICLE 4. INTELLECTUAL PROPERTY
The content of this Site is the property of the Fondation. You have permission to view the information contained herein for your personal use only, to the exclusion of any commercial use whether locally, nationally or internationally.
The content of the Site, including, but not limited to, all trademarks, drawings, models, images whether animated or otherwise, texts, photographs, logos, graphic charters, software and programs, search engines, databases, sounds, videos, domain names, the design, the Fondation’s know-how, and any other content thereof, is the exclusive property of the Fondation, of its partners or of third parties that have granted it licensing, and is protected by intellectual property rights that are or will be owned by them under the laws in force.
No element constituting the Site, in particular the logos, texts, sounds, graphics or images contained in the Site, may be copied, reproduced, modified, published, transmitted, posted, communicated or distributed in any way whatsoever, in whole or in part, without prior written permission from the Fondation, with the exception of their strictly private and non-commercial personal use with no modification to any of the elements present on the Site.
Any other use of the Site or its components not expressly authorized shall constitute a violation of the rights of the Fondation subject to prosecution for infringement, punishable by articles L. 335-2 et seq. of the French Intellectual Property Code.
ARTICLE 5. HYPERLINKS
The pages of this Site may contain links or references to other sites. The Fondation cannot vouch for the content of such other sites and shall not be liable for any damages arising from the use of content from these other sites. Links to other sites are provided solely for the convenience of Users of the Site.
ARTICLE 6. LIABILITY
6.1 Limitation of Liability
The Fondation will make every effort to ensure the accuracy and updating of all the information contained on this Site but cannot guarantee that the information provided is complete, precise, accurate, exhaustive, and free of all errors. The Fondation reserves the right to correct or modify the content of the Site at any time without notice.
The Fondation, its licensors, officers, agents, employees, successors and assigns disclaim any responsibility concerning the information available on this Site and any use thereof, or concerning information that may be obtained in response to questions asked through said Site.
The Fondation’s liability may not be sought in case of a breach of its contractual obligations due to an unforeseeable or force majeure event as defined by French jurisprudence. Consequently, a User may only invoke the Fondation’s liability if the User can prove actual misconduct or negligence.
6.2 No Guarantee
The Fondation provides no explicit or implicit guarantee, and assumes no warranty for the use of the Site or its contents. The Fondation shall not be held responsible in any contractual or tortious liability lawsuit, or any other proceedings, for any harm, whether direct, indirect, incidental or consequential, or of any kind whatsoever, arising from the use of the Site or its contents, as the result of any interruption or any kind of malfunction, for any reason whatsoever, in particular regarding lost profits, business interruption or data loss. Any person connecting to the Site does so exclusively under his or her own responsibility.
ARTICLE 7. PROTECTION OF PERSONAL DATA
The Fondation collects Users’ personal data only in the context of their use of the Site, in particular when they choose to enter such data through the contact form available on the Site.
A declaration has been made to the Commission Nationale Informatique et Libertés (CNIL) [national computing and freedoms commission] regarding the automated processing of personal data conducted via the Site. The information required for the proper processing and execution of requests is marked with an asterisk. If no response is provided, or if the information provided is incorrect, the Fondation cannot process the request. The other information requested, for which a response is optional, is intended for the development of a greater familiarity with Users, so as to improve the services offered to them.
In accordance with Law No. 78-17 of January 6, 1978 on Information Technology, Data Files and Civil Freedoms, Users have a right to access, correct and delete data concerning them. They may therefore demand that personal data relating to them that is inaccurate, incomplete, equivocal, or expired be corrected, completed, clarified, updated or deleted.

ARTICLE 8. COOKIES
Connecting to the Internet server results in the transfer through the browser of a certain amount of data, stored on the hard drive of Users’ computers. They are used by the Fondation to facilitate Users’ navigation of the Site. The computing technologies used for gathering this information are referred to as “cookies.”
Users may also configure their browsers to accept or reject cookies on a case-by-case basis before they are stored on their computers. They may also periodically delete the cookies from their device through their browsers.
Each browser has a different configuration procedure for managing these preferences and cookies. The browser's help menu shows Users how to change their cookie settings.
It is specified that disabling cookies may prevent the use of or access to certain features of the Site.
ARTICLE 9. AMENDMENTS TO THE TERMS OF USE
The Fondation reserves the right to amend these Terms of Use at any time without notice, in order to adapt said Terms of Use to changes made to the Site and/or its operation.
ARTICLE 10. GOVERNING LAW AND JURISDICTION
These General Terms of Use are governed by the laws of France. Any difficulty of interpretation or execution shall fall exclusively within the jurisdiction of the Appeals Courts of Bordeaux.
